Binding Arbitration
Should informal negotiations fail to resolve a Dispute, the Dispute (with specific exceptions noted below) will be conclusively settled through binding arbitration. IT IS IMPORTANT TO UNDERSTAND THAT THIS CLAUSE MEANS YOU WAIVE THE RIGHT TO SUE IN COURT AND FORGO A JURY TRIAL. The Parties may go to court to enforce arbitration, pause ongoing court proceedings during arbitration, or to confirm, modify, overturn, or enforce the arbitrator's award.
Restrictions
The Parties concur that arbitration will be exclusively between them, dealing with their individual Dispute. As far as the law allows: (a) no arbitration will be combined with another case; (b) there is no permission or authority for Disputes to be arbitrated as a class action or to use class action methods; and (c) Disputes cannot be brought in a supposed representative role on behalf of the public or other individuals.
Exceptions to Informal Negotiations and Arbitration
The Parties recognize that certain Disputes are not subject to the aforementioned conditions of informal negotiations and binding arbitration.
